These terms apply to all members of HMD Basel. They follow the general terms of participation of the groups affiliated to HMD Italia (version 2026-09-29), and differ only where Swiss law or HMD Baselâs set-up requires it.
For members affiliated with HMD Italia, HMD Italiaâs general terms of participation also apply. Where the two differ, these terms apply to HMD Basel members, as far as Swiss law requires or HMD Italia has agreed.
The English text of these terms is authoritative.
1. Scope and membership
1.1 These terms govern membership of and participation in the activities of HMD Basel, run by Ass. Hwalmoodo Switzerland, an association under Articles 60 ff. of the Swiss Civil Code. They cover classes, training plans, gradings, events and related services.
1.2 Membership begins with the application, payment of the annual membership fee, and the choice of a training plan.
1.3 The statutes and internal regulations of Ass. Hwalmoodo Switzerland form part of the membership relationship. By registering, the member accepts them.
1.4 HMD Basel may publish specific conditions for individual plans, offers or events, which supplement these terms. Where the two conflict, these terms prevail.
2. Fees
2.1 Activities involve:
a) the annual membership fee, payable to Ass. Hwalmoodo Switzerland: currently CHF 30 per year, unless the plan states otherwise;
b) training-plan fees (for example monthly, yearly or student plans), at the prices published on our website;
c) any fees for specific events (gradings, seminars, competitions, camps), communicated in advance case by case.
2.2 Fees are due for the relevant period and are not apportioned for absences or voluntary interruption of activity. Unless the plan states otherwise:
- monthly plans renew automatically each month, for up to 12 months
- yearly plans do not renew automatically
2.3 Non-payment by the communicated deadline results in suspension of access to activities and events until the memberâs payments are brought up to date.
2.4 Payments are made through Payrexx, by TWINT or debit/credit card, or by another method shown at checkout. Introductory offers (for example a reduced first month) apply only on the conditions published with the offer.
3. Health
3.1 HMD Basel does not require a medical certificate. Each member (or the parent or guardian, for a minor) is responsible for taking part only when their state of health allows it, and for consulting a doctor if in doubt.
3.2 Before class, members inform the instructor of any injury or health condition relevant to training safely. The instructor uses this information only to adapt the training and does not record it.
4. Insurance
4.1 HMD Basel does not insure its members. Members must have their own accident insurance. In Switzerland this is normally the accident cover of the compulsory health insurance, or the employerâs accident insurance. Private liability insurance is recommended.
4.2 Members may take out further insurance cover independently of HMD Basel.
5. Participation and conduct
5.1 Members are expected to:
- be punctual
- use the prescribed protective equipment
- respect instructors and other members
- follow the safety rules, the internal regulations, and the regulations of the facilities and hosting partners where activities take place
5.2 HMD Basel may exclude from activities anyone who endangers their own safety or that of others, or who prevents activities from running properly.
5.3 Class schedules may change for organisational reasons, holidays, seasonal closures or events. Changes are communicated with reasonable notice. If classes are unavailable because of holidays or facility closures (for example the August break), HMD Basel may extend the current plan or move the next billing date, and tells members in advance.
6. Withdrawal and refunds
6.1 Members may withdraw by giving written notice to info@hmdbasel.ch. For training plans, unless the plan states otherwise:
- a monthly plan can be cancelled with effect from the next billing period, if notice is given before that period begins;
- a yearly plan cannot be cancelled once activated.
In both cases, access continues until the end of the period already paid, and automatic renewal then stops.
6.2 Fees already paid (membership and plan fees) are not refundable, except at the sole discretion of HMD Basel on serious and documented grounds of force majeure.
6.3 HMD Basel may suspend or terminate a membership or plan with immediate effect in case of:
- a serious breach of the internal regulations
- misconduct
- non-payment
At its discretion, HMD Basel may refund the remaining period pro rata.
7. Events, gradings, seminars and equipment
7.1 Participation in gradings, seminars, competitions, camps and other events is optional and involves separate fees, communicated case by case. The regulations may, however, require participation in such events for advancement in grade.
7.2 Technical equipment and protective gear must meet the safety standards prescribed by the instructors and by the competent federations. Equipment that is not approved or is damaged may not be used. Without compliant equipment, access to activities may be suspended until the matter is resolved.
7.3 Equipment sold by HMD Basel (for example uniforms and protective gear) is sold on the supplierâs terms: payment in advance, and no returns unless the item is defective. Statutory warranty rights that cannot be excluded remain unaffected.
8. Liability
8.1 The disciplines practised carry an inherent risk of injury. Members take part knowingly and undertake to follow technical and safety instructions and to comply strictly with the instructorsâ directions.
8.2 HMD Basel is liable for damage caused by its own wilful misconduct or gross negligence, and that of its instructors and collaborators. To the extent permitted by law, it is not liable in particular for:
- injury or damage attributable to the condition of the facilities, premises and areas used, where these are not run directly by HMD Basel;
- injury arising from unforeseeable events or from improper, careless or unauthorised use of equipment and materials;
- the consequences of failing to follow the technical and safety instructions given by instructors;
- injury connected to undisclosed health conditions or to disregard of medical prescriptions;
- theft or loss of personal belongings left unattended on the premises.
This list gives examples and is not exhaustive.
9. Changes
9.1 HMD Basel may amend these terms or the internal regulations where legal or operational requirements change, giving at least 10 daysâ written or digital notice. Members who have accepted these terms receive the updated version by email.
9.2 A member who does not accept the changes may withdraw as set out in section 6. They then receive a pro-rata refund of the training-plan fee for the remaining period; the annual membership fee is not refunded.
10. Personal data
10.1 Personal data are processed as described in our Data Privacy Policy:
- by HMD Basel
- for members affiliated with HMD Italia, also jointly with HMD Italia where it is involved
- in accordance with the Swiss Federal Act on Data Protection and, where it applies, the EU General Data Protection Regulation
10.2 Notices, invoices and other communications about the membership are sent to the email address given at registration.
11. Governing law and jurisdiction
11.1 These terms and all membership agreements are governed by Swiss law.
11.2 For any dispute arising from these terms or a membership agreement:
- where the member is a consumer, the courts at the memberâs domicile have jurisdiction, and the member may also bring proceedings in Basel, as provided by the Swiss Civil Procedure Code;
- for members domiciled outside Switzerland, the Lugano Convention applies where relevant;
- in all other cases, the courts of Basel-Stadt have jurisdiction.
